Aries Adaptive Media, LLC, a North Carolina limited liability company d/b/a Reflex Radio ("Company" or "We") respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the website www.reflex-radio.com (our "Website"), or when you install, access or use any Reflex Radio Mobile Application (the “App”) and our practices for collecting, using, maintaining, protecting and disclosing that information.

This policy applies to information we collect:

  • Via the App.
  • In e-mail, text and other electronic messages between you and this Website and/or the App.
  • Through any mobile and desktop applications you download from this Website, which provide dedicated non-browser-based interaction between you and this Website.
  • When you interact with our advertising and applications on third-party websites and services, if those applications or advertising include links to this policy.

It does not apply to information collected by:

  • us offline or through any other means, including on any other website operated by Company or any third party (including our affiliates and subsidiaries); or
  • any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or on the Website or App.

Persons Under the Age of 13

The App and our Website is not intended for persons under 13 years of age. No one under age 13 may provide any information to or on the Website. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will take all commercially reasonable measures to delete that information. Information We Collect About You and How We Collect It

We collect several types of information from and about users of our App and Website, including information:

  • by which you or third parties such as attendees to our events may be personally identified, such as name, age, postal address, e-mail address, telephone number, or any other identifier by which you may be contacted online or offline ("personal information");
  • financial information required to process any purchases on the Website or through the App, such credit card information;
  • that is about you but individually does not identify you;
  • that is used to register with the App using your existing social media account details, such as Facebook, Twitter or other social media account (such social media login information to be collected as set forth herein); and/or

  • Automatically as you download the App, navigate through the site or App. Information collected automatically may include usage details, IP addresses and information collected through cookies and other tracking technologies.
  • With respect to social media logins, from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, contacts list, profile picture as well as other information you choose to make public on such social media platform. This information will only be used for the purposes that are described in this privacy policy.
  • From third parties, for example, our business partners.

Information You Provide to Us. The information we collect on or through our App or Website may include:

  • Information that you provide by filling in forms in the App or on our Website. This includes information provided at the time of registering to use the app or our Website, posting material, subscribing to our service, or requesting further services. We may also ask you for information when you enter a contest or promotion sponsored by us and when you report a problem with the App or our Website.
  • Records and copies of your correspondence (including e-mail addresses and phone numbers), if you contact us.
  • Your responses to surveys that we might ask you to complete for research purposes.

We do not store credit card numbers, security codes or identifiable credit card data but pass that data through PCI compliant gateways at the time of charging. We may use this information for billing purposes, and to share this information with authorized, event-related third parties.

You also may provide information to be published or displayed (hereinafter, "posted") on public areas of the Website, or transmitted to other users of the Website or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

As you navigate through and interact with our Website or when you download, access and use the App, we may automatically collect certain information about your equipment, browsing actions and patterns, including:

  • The location and tracking information is central to the App. To fully avoid the collection of such location and usage information you will need to cease using the App and removing it from your mobile device.
  • If you do not want us to use your e-mail address or other contact information to promote our own or third parties' products or services, you can opt-out by logging into the Website or App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to contact@reflexradio.app.
  • If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by adjust your user advertising preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to contact@reflexradio.app. If we have sent you a promotional e-mail, you may send us a return e-mail asking to be omitted from future e-mail distributions. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.
  • If you do not want us to share your personal information with unaffiliated or non-agent third parties for advertising and marketing purposes, you can opt-out by logging into the App and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes or by sending us an e-mail stating your request to contact@reflexradio.app.

We do not control third parties' collection or use of your information to serve interest-based advertising. However these third parties may provide you with ways to choose not to have your information collected or used in this way.

Your California Privacy Rights

California Civil Code Section § 1798.83 permits users of our Website and App that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. General Data Protection Regulation (GDPR) Privacy Policy Addendum

 

Definitions

 

As used in this Addendum, capitalized terms otherwise not defined herein (including, without limitation, “Personal Data” and “Processing” shall have the meanings given in the GDPR; provided however that “Personal Data” shall mean any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

 

Persons Under the Age of 16

 

We do not knowingly collect or solicit Personal Data from anyone under the age of 16. If you are under 16, please do not attempt to register for the Site or send any Personal Data about yourself to us. If we learn that we have collected Personal Data from a child under age 16, we will delete that information as quickly as possible.
